@officialxraided: Disappointment and emotions have been running high since we received the news that Erik and Lyle were denied parole, but here’s the bottom line - coming from someone who also had to go to Board: there was no scenario where Lyle and Erik were going to be granted parole on the first try. That was never something myself nor the attorney who got me through the Board - @carbone.charles - expected to occur. I didn’t want to say that publicly but we were expecting a Three Year Denial for both brothers and that’s exactly what occurred. Civilians don’t think it’s a big deal to have a cellphone or other minor things that may occur in society BUT - to the Board - these infractions indicate a continuation of anti-social behavior that can create a nexus to the commitment offense. Meaning that we broke the rules in society and we broke rules in prison… which implies that we won’t follow the rules outside of prison either. That’s the logic they apply 100% of the time. It is NOT abnormal for the Board to take that position. If Erik and Lyle were granted parole on the first try with those recent disciplinary infractions, thousands of other inmates who were not afforded the same outcome would have flooded the courts with arguments about preferential treatment. The Board would have to apply the same standard to everyone else. I guarantee you, someone was denied parole for possession of a cellphone that exact same week. The PRECEDENT that a parole grant would have set with recent disciplinary infractions would have caused a HOST of problems for CDCR and may not have made it past the governor. Politics. Always. SO… I repeat: NO ONE would have been granted parole on the first try under these circumstances. That was ALWAYS an unrealistic expectation. The good news is that they will stay out of trouble for 18 months, return to Board in February of 2027, receive a finding of suitability, be approved and be home by June of 2027 - barring a victory in the Habeas proceedings before then.
