There may be options: 1️⃣ Cancellation of Removal (Non-LPR): Must prove 10 years in the U.S., good moral character, and extreme hardship to a U.S. citizen or resident spouse, parent, or child. 2️⃣ 245(i): If he had a petition filed on or before April 30, 2001, he may still qualify to adjust status. 3️⃣ Parole in Place: If you, your children, or his parents served in the U.S. military, he may be paroled and then adjust. 4️⃣ 601A & I-212 Waivers: Ask the court to terminate proceedings, apply for waivers, leave the U.S., and re-enter with a green card. 5️⃣ Bonus Option: Asylum, withholding of removal, or Convention Against Torture if returning home is life-threatening. I just got to the US with a J1 visa and have a valid DS2019 which was signed at the embassy and says I am not eligible for the 2 year home residence which is a relief. Unfortunately I only got 3 months on my visa and if I need to get back home I will have to apply for a new J1 visa. Will I need the old signed DS2019 which is valid till 2028 or I will be issued a new DS2019 which will have to be signed again and hence risk having to be told that I now have to satisfy the home residence requirement?
