Key part in that is he can't file the charges he can contact the district attorney and see if he has something to charge him which he doesn't because what he's doing is lawful and constitutionally protected and cannot be Charged with the crime simply to be punitive cops are not allowed to use discretion punitively In other words you can't just charge somebody with a crime because you want to That would be deprevision of rights under color of law
