Splashing water on someone without their consent is not harmless fun. In South African law it can amount to assault. According to Section 1 of the Criminal Procedure Act 51 of 1977, “assault” includes the unlawful and intentional application of force to another person, directly or indirectly. This means that even throwing or splashing water is legally recognised as an application of force. If this is done to a police officer while on duty, it becomes more serious and can lead to additional charges such as assaulting or interfering with a police officer in the execution of their duties. If you are a victim, you should go to the nearest South African Police Service (SAPS) station and open a case of assault. Provide a full statement with the details of the incident, including the time, place and people involved. If you have witnesses or video evidence, submit this as part of your case. If the incident was caught on camera, the video can be used in court as supporting evidence. Make sure the footage is provided to SAPS so it can be added to the case docket. This strengthens the case and increases the likelihood of prosecution. Consent matters. What may seem like a joke or prank to one person can amount to a criminal offence against another.
