It’s a lot more factors to determine if you’re code compliance than just wire and breaker. Real electrician would know that

All wrong wire is good for 45 amps code allows us to go to next breaker size which is 5o amps 240.6

None if it’s not a continuous load and it says on the unit maximum breaker size between 40 and 50 A

It’s good for 40 to 55 A odds are depending on what it is. It’s not against code.

Seems to be a common thing. When I was an apprentice the guys above me were always telling me use 8 NM for a 50 amp circuit.

depends on what one want to assume nmb wire is considered as. because of insulation, it has to be debated, but if we have it in conduit, thhn it can be used on a 50.. 20 yrs ago nmb #8 was good all day every day on a 50. but if I interpret code. the breakers protect the equipment, not the wire.

#8 is rated for 55amps at 90°c; if you're in the sunbelt there is nothing wrong with #8/50A.
