1. Qatar by granting Hamas safe haven in its territory does so in violation of Security Council Resolution 1373 (2001). Qatar is under a legal obligation to dismantle any infrastructure that can be used by Hamas to facilitate violence against Israel. The fact that Qatar has failed to do so gives rise to a newish untested principle called the “unwilling or unable principle” which is self explanatory. This principle can be used in conjunction with Art 51 right to self defence ie a State can use military action without the consent of the other State within that State’s territory. The action must meet the imminence, necessity and proportionality requirements of Art 51.

The question is why wasn’t Qatar able to defend itself? They should have taken immediate action especially when you have the US sitting in Qatar. What’s the point of crying about it now. Also why did Saudi give them air space to allow them to strike.

Article 51 of the UN Charter states : Nothing in the present Charter shall impair the inherent right of individual or collective self-defence if an armed attack occurs against a Member of the United Nations, until the Security Council has taken measures necessary to maintain international peace and security. Measures taken by Members in the exercise of this right of self-defence shall be immediately reported to the Security Council and shall not in any way affect the authority and responsibility of the Security Council under the present Charter to take at any time such action as it deems necessary in order to maintain or restore international peace and security. Nowhere does it mention that a third party state, Qatar in this case, needs to consent to the defence. So Israel is quite within their rights.
