Wait, they said Tender sounds too much like Tinder? When Tinder literally came after Grindr?

The word swipe has been around since 1807. Is that really eligible to be trademarked? Reminds me of easyJet thinking they own the word easy

So to my knowledge (not a lawyer), copyright only covers the industry that the company is active in, so if you can argue it’s a different industry then there’s not much they can do…

Feels like when Wizards of the Coast trademarked the word "tap" for use in card games, which is why so many other card games turn the whole card over or around instead of just turning them 90 degrees.

I downloaded the app when you mentioned it. Give up though, it’s not worth the time and headache trying to fight it, although you should. Trust me.

Not sure which country you are in but at least to me (not an expert), in the UK Tinder does NOT have to TM to "Swipe right" in this instance: for a tv/video series (class 41) and clothing (class 25): neither of which your app would fall under.

I'm pretty sure (not a lawyer) that unless you make money it's not infringement as the provisions in UK law state "under the course of trade" and it's not trade if you don't make a payment.

Regarding the name Tender, you will probably loose as it is usually considered that only 1 letter difference is not enough to differentiate you from the original brand.

Is it public the app? If not you possibly can argue that the its a home project that il was jot made for sharing.

I got an Apple Notice of Complaint in 2018 for a French speaking app (unreleased) I called Parler... Three years later, the app that took the name ended up being used in the January 6th riots. (And that's how I'm tangentially related to January 6th)

Do you say "swipe right" in common speech on any other dating sites? If yes there's legal ground to challenge a trademark if it's become a verb. Definitely one for the lawyers to fight over tho.

not copyright - trademark. This is important. Trademarks are about words specifically, not functionality.
