@hr_explained: Replying to @smokey The original premise for salary-exempt staff was that their pay wouldn’t change on weeks where they worked more or less hours. And if they worked less hours (like during a slow time) and maintained their pay, then overtime pay wasn’t needed. But the reality of exempt work is many exempt staff don’t have a slow time. They work 40 hours or more, all the time. Some states understand this occurs and have passed higher salary thresholds, like Washington. And because WA has these high minimums, you can absolutely expect many employers will convert salary exempt staff to hourly staff. Any job can be hourly or non exempt. But not every job can be exempt. Aside from the pay aspect, in order for a job to qualify as salary exempt, strict criteria has to be met. And if that criteria isn’t met, the job cannot be salary exempt. So if exempt employee is out for half a day say for an appointment. They come in and employer used sick time for time they were out, is this legal?

Communication is so important, such as if I’m expected to work over or come in earlier… I then will have a conversation with my employer that I will be leaving earlier or coming in later on a certain following day due to this. Conversations and expectations need to be shared

The phrasing makes zero sense to me, but I will say any employer that tries to deduct from Salary Exempt Employees is taking a large risk. The general premise behind Salary is that regardless of hours worked your pay is set, both hours up or hours down. It would be a big risk to take that to court.

Hello! How about if the employee is on intermittent FMLA and is only allowed to work for hours. Can I put in four hours and un pay time or do I have to enter a vacation or sick?

What?! I finally became salary a couple of years ago and I love it. Most weeks I do work 42-43 hours and more if it’s busy. But I’d be so mad if on another week that would deduct if I worked less! To me it all equals out over the year

so grateful for my employer allowing flex time. we work over here, we work under there. if we take flex time, we're expected to be available if needed for phone call stuff but we're all very happy with it and we're pissed about the state thinking about making us non exempt and having to track our hours
