Judge Huey Cotton sustained an argumentative objection on Friday when attorney Brian Panish said playing professional baseball is not “a real job.” Panish was questioning retired Major League Baseball player Scott Erickson about his $13,000 monthly (before taxes) MLB pension on Friday when he said, “And because since you were in baseball, you never had a real job, you started taking the money, right?” “That’s argumentative,” Erickson’s lawyer Jeff Braun said. “Rephrase,” Judge Cotton told Panish. Panish asked Erickson about his previous work as a color commentator for the now-defunct Pac-12 Network. “And how many years were you on that?” Panish asked. “About eight years,” Erickson answered. “Eight years. That's the only job you've had since you've been out of baseball?” Panish asked. “I know I was a pitching coach for two years with the Cleveland Indians in the minor leagues,” Erickson answered. “So is there any reason that you can't go out and work now?” Panish asked. “I've not been able to get a job since the accident,” Erickson answered. He testified he applied for jobs as a pitching coach and tried to return to the Pac-12 Network before it ended. “Who did you apply for a pitching coach job with?” Panish asked. “Just about every team,” Erickson answered. “So you contacted the team, send them a letter, say, ‘I’d like to be considered as a pitching coach’?” Panish asked. “Not after 2020 I have not,” Erickson answered. He said he tried to return to the Pac-12 Network when baseball returned during the pandemic. “They didn't give it to you, did they?” Panish asked. “No, they did not,” Erickson answered. Panish will continue questioning Erickson on Monday in the punitive damages phase of the wrongful death lawsuit for the Sept. 29, 2020, deaths of brothers Mark and Jacob Iskander, who were in a crosswalk in Westlake Village, California, when Grossman struck them in Mercedes-Benz AMG. Jurors on Wednesday said Erickson and Grossman are liable for $176 million in damages. They also said they acted with malice or oppression (or fraud for Erickson), which opens them to punitive damages. #law #MLB #sports
