Black communities also face more over-policing which leads to a disproportionate amount of arrests. Those same communities are usually in lower socioeconomic areas which leads to more black people being taken advantage of by the legal system because they couldn't afford good legal representation. Public defenders are usually overworked and are far more likely to push their clients to take a plea deal leading to a disproportionate amount of black people taking plea deals for crimes they didn't commit.

What about the ones who are wrongly accused and let out years later because they were found guilty simply because of the colour of there skin. Taking into account how racist cops are and how many people have been falsely accused the number of black people in jail does now mean they committed more crimes at all.
