1. The Law and the Oath: A soldier is not just a civilian with a gun. He is a Government Security Agent. He voluntarily took an oath to uphold the constitution and protect citizens, not to harm them. His weapon and authority are paid for by the nation to serve the public. When he uses that given power to murder an innocent citizen, it is a profound betrayal of that oath and a direct attack on the nation's legitimacy. The military court martial him to uphold its own discipline and integrity. If they did not, it would signal that soldiers are above the law, which is a dangerous path to anarchy.
2. Upholding the Rule of Law: By court martialing and sentencing this soldier, the Nigerian Army is making a powerful statement “they are subject to the law. They hold themselves accountable.” This is a cornerstone of a civilized society. We cannot demand that the nation defeat lawless bandits while also asking it to overlook murder within its own ranks. That would make the nation no better than the criminals it fights.
In summary, the soldier's case is about internal discipline and upholding the rule of law within the institution meant to protect us. The bandit crisis is about an external threat that the nation is struggling to contain. It is not that one life is more valuable than another. It is about the source of the violence and the obligations of the perpetrator. The nation must be held to a higher standard. Failing to punish this soldier would mean it is failing that standard. A trained soldier is meant to protect lives and property of the law abiding citizens. Lastly, the civilians are subjected to just the civil law, the military is subjected to both the civil law and the military law. Note, the military law is very brutal and shows no mercy. Those bandits can get away with the civil law, but if a soldier gets away with civil law, trust me they won’t escape military law.
