Disclaimer: I am not siding to anyone. I’m just stating what I think is right. First of all, I disagree atty. Dahil ang importante is need mailabas lahat ng info from discaya and for the discaya to do that they need to feel safe and thats what marcoleta is trying to do. Why not ipasok sila sa WPP para maexpose lahat and once na matapos ang investigation, saka ipasaoli ang mga ninakaw nila ?

Marcoleta’s main point is to put the Discayas under the Witness Protection Program (WPP) first so they can safely testify and reveal more names like Sandro Marcos, Martin Romualdez, other congressman o senators and documents that could expose the real masterminds of the corruption scheme. Being in the WPP doesn’t mean they get away with their crimes. If later on the court finds them guilty, they can still be ordered to return the stolen property or face other penalties. That’s why Marcoleta said restitution is not a requirement to enter the WPP — it comes after the case has been investigated and decided. On the other hand, Senator Tulfo’s line about “bending the law to please the people” may sound appealing to the public, but it’s actually risky. If lawmakers keep bending the law depending on what’s popular, it weakens our democracy and puts everyone’s rights in danger. The proper way is to change the law through legislation, not just twist it in the heat of a hearing.

Atty. Tama po, malinaw sa Section 2 ng RA 6981 na may kapangyarihan ang DOJ "to formulate and implement" the Witness Protection Program. Pero ang formulation dito ay tumutukoy sa rules and guidelines ng pagpapatupad ng program, hindi sa pagdaragdag ng bagong condition bago maAccept as a State witness, dgaya ng restitution kung wala naman iyon sa mismong batas. Ang restitution ay ibang konsepto na sakop ng Revised Penal Code at Civil Code at hindi po direktang bahagi ng Witness Protection Act.
