Would it be a violation if the vehicle was off before touching the phone? (since this situation seems ridiculous) can a officer give you a ticket in a vehicle thats parked basically (and yeah I know parking in a drive thru...) but just curious.

If I’m him go to court fight that that officer is a complete fucking idiot there’s no other way to say that you know you have to pull your phone out. If you go to one of these places they always ask for the app. I hope you win man.
