I agree, 100%. AI is not as sentient being, and therefore it cannot own anything or have a right to anything. It can’t even really create anything. It can only use programming to re-create what is already out there in a different way.

The settled law of this case actually indicates the exact opposite here. It is used to demonstrate AI art is copyrightable because a human gave the AI instructions and the AI is a tool that executes your will, making it copyrightable work vs nature doing something not under your control. AI will be considered the same as the camera equipment or a phone/app and is just a tool. Additionally, the case doesn't settle the definition of ART, just what is copyrightable and owned by another human. It settles what a copyright is. not what art is.

it's interesting to me that when talking about the photo you said "it was determined that a non human entity could not create copyrightable art" and you follow that up with the question "can AI create art?" those are two different questions, and the case has no bearing on one of them. nobody questioned if the monkey can create *art*, only the question of copyright. most people agreed it WAS art, until they realized they needed to move the goalposts to exclude AI. No, AI cannot create copyrightable art, just like a monkey cannot. But, AI CAN create art, just like monkeys can, and just like a vast number of nonhuman can. assuming art is solely the purvue of humans is the height of egotism.

not fully correct: 1. animals can make art. Exhibit 1: humans. Exhibit 2: a toddler Exhibit 3: dogs and elephants have been shown to make art when they learn how to draw Exhibit 4: the makaak 2. An ai could make art of that's its intent 3. LLM and other generators don't have intent, therefore they can't make art as there is no decision to express themselves as they can't do that by design 4. currently no ai on earth can make art intentionally cause no ai has intent in any sense of the word 5. the most important: LLMs aren't AI, they're the algorithm an AI spits out as a model for what the ai calculated would be the best method to generate a response based on the training data. An LLM is to AI as the formula f(X) = 2x + 3 to a human. Thank you for listening to my ted talk
