Idk about the state this arrest occurred in, but in Arizona, Disorderly Conduct is an intent/Awareness crime. This means they have to prove that a person intended to disturbed the peace or knew that his actions were disturbing the peace. So, in this case, they have to prove that the driver had intent or knowledge for the charge to stick.

man cops are dumbbbbbbb "I'm gonna put a complaint form" " ok I'm gonna write unfounded and file it away" that's premeditated and illegal lmao they just keep digging the hole, disorderly conduct involves distrupting the peace on a level such as breaking stuff interrupting performances, and usually there has to be a factor of inebriation, telling a cop on the side of the road to suck a fat one isn't fistrupting the peace scotus has found multiple times cussing at cops isn't illegal lol
