When the surviving spouse later dies, the property reverts to the deceased’s family - not to the spouse’s side. This rule applies whether the property was acquired before or during marriage, or through the deceased’s sole effort, unless it was registered in joint names or gifted through a valid will. So, if a husband dies and leaves no children, his wife enjoys a life interest in his estate, and when she dies, that property passes back to his family. Likewise, if a wife dies first, her husband would have a life interest that ends at his death.
