I’m confused because this is literally just IRAC with a counter argument? How were you writing before this??

Retired law professor. This is exactly what needs to be done. If law school essay questions are written correctly there will be facts in which you can answer the conclusion is "A" and facts in which the conclusion is "B." Law school should teach the student that in the law there is always two ways to see an argument. The sooner a student understands this the sooner they will do better on their exams.

it’s fr just a counter analysis and a rebuttal of that counter analysis. Legal writing 101.

i did a practice exam that way and my prof hated it 😭 but i think it works if you don’t try to stretch a side that clearly does not have a valid argument

This is true but also know what your professor wants. I have one professor that always says “pick one side and argue it in your essays. I don’t want to be hearing both sides.”

I truly don’t think there’s another way to do it, to the point I’m concerned that people might not be doing this. I don’t understand what the alternative is, not even trying to be snarky.

Will defendant argue there is “no contract” because the SOF applies, or will they argue the contract is unenforceable because the SOF applies? How much of your analysis focuses on the SOF as an affirmative defense vs an outright denial?
