Can you not offer “light duties” if it then makes it unfair to others? eg basically halving the workload of the others?

my work has fired people for absences due to sickness, but if you come into work sick they will not send you home making it a authorised absence but rather tell you if your not well go home, so you take the absences and not them, surely under this you could win a unfair dismissal case then

I am off due to work place stress, now entering my 3rd month. Work have only just started and oc referral and have not discussed any reasonable adjustments or changes. This happened previously end of December 2023. I went to oc and did everything that was asked but no changes were made at work so it all just built up again.

I work as an personal assistant. half of the team have been on long term sick since March, I wish our employer would hurry up through the process so we can finally move on and employ some other people. its extremely difficult for those of us who are there everyday even when we are unwell because otherwise one of us are on our own. its not fair to those that are battling through and drowning with work load. I dont see why its taking so long for them to sort it. we also get no updates, I know we are not entitled to it but some light at the end of the tunnel would reduce a little stress at least

You absolutely can be dismissed, I was dismissed by NHS after 12 months, I had a disability from a car accident, I couldn’t consistently do my job or any other alternative they had available so lost my career.

I am protected under the Equality Act. My employer failed to consider or implement reasonable adjustments and refused to increase my working hours. Since returning to work, I have not been absent due to sickness. Despite clear medical advice and recommendations from Occupational Health, they ignored these and used “budget constraints” as an excuse to deny my request for an additional hour during my return phase.
Occupational Health had specifically advised that my hours be increased, as I was not performing “light duties” within the six hours I was working. However, the employer disregarded this and failed to follow the professional guidance provided. Instead, they booked me into a Contractual Review Meeting, which I had no choice but to attend, as they stated it would proceed without me. When I asked for the reason, they said it was due to capability related to illness. they also failed to address my grievance before then.
This was unfair, as they had not provided the reasonable adjustments I am entitled to request under the Equality Act. I have been challenging a culture of ableism within the organisation, which has been cultivated over decades and remains male-dominated. I am now taking this matter forward.

I fell down some on a London double decker bus, last august. Because I’m on warfarin I was admitted to royal London and kept in for a week, where I should have gone in for a deep clean and a training day. I think they thought I was taking the piss. But I needed a mri, before I was allowed home. But that’s the second warning I’ve had and they were so unfair and gave me no birth of explaining the situation

But what if your absence is due to let’s say work related stress for example but the stress was caused by a discriminatory act by an employee which the employer is failing to investigate ? What would one advise to do?

If I'm absent due twice due to non disability related issues then the third time its a mix of disability related reasons and non disability related reasons can my employer still go down the formal absence process? this is what happened to me and they made an official log on my file and advised they will be closely monitoring my absence the next 12 months like they do any other employee with 3 absences in a 12 month period.

What rights do you have in relation to phased return hours, does the individual have a say in this or is it set by HR irrespective of fit note recommendations and/or OH report highlighting a phased return with reduced hours.

recently had to dismiss someone who was off sick. they were off because they wanted completely unreasonable disability adjustments. they refused to return to work despite a shopping list of RAs I offered. they refused to turn to work unless all her RA suggestions were implemented without question.
