but Pennsylvania v. Mimms also protects the passenger in a situation like this. the case law also states that the traffic stop starts and ends with the driver unless they witness the passenger specifically commit a crime in their presence.

if we're talking about case law here's one that officers love citing, Pennsylvania v. Mimms which lawfully gives officers permission to remove the driver from the vehicle on grounds of "officer safety". it's often abused and usually cited when the individual either invokes his 4th or 5th amendment or questions authority.

the case law that the Sergeant cites has nothing to do with what they are attempting. California v. Lee is case law about a traffic stop where officers illegally searched a car and found narcotics and a firearm which long story short Lee won an appeal that suppressed that evidence due to it being obtained illegally. that's literally all that case law states

Yes, the principle of Pennsylvania v. Mimms applies to passengers, meaning police can order them out of a lawfully stopped vehicle for officer safety, as later clarified and extended by the Supreme Court in Maryland v. Wilson. This is a minimal intrusion justified by the increased risk to officers when multiple people are in a car, outweighing a passenger's reduced expectation of privacy in public
