The cop said the charge is resisting arrest. She was never read her rights so how she under arrest prior to having her rights read.

If you’re not drunk, you get out of the car you go to headquarters they do a breathalyzer on you and you’re not drunk to go home. End of story this is how not to cooperate with police.

To be fair, if I hadn't been drinking, I would be annoyed also. Whatever the law is here, there is a simple test they can do roadside like the rest of the civilized world and this would be over. Rather than getting arrested and testing in the station and being released if she didn't do anything wrong. Waste of both of their time.

You know, I’ve watched enough of these videos to realize that resisting arrest really never does anything positive. So even if I think they’re in the wrong and even if I think I’m being falsely accused, and even if I’m being severely inconvenienced in my life, I’m gonna shut up and do what they say. Afterwards, if I have any grounds whatsoever, I will sue them. But while it’s happening, I’m not gonna make it worse for myself.

yeah that law needs revamped. They suspect your drunk, can't prove it, but you're coming down to the station with us.... definitely inconvenient. And when she test negative? oh sorry about that...? Dumbest shit ever. I'm sure they get sued all the time.
