Only after they develop the required suspicion or cause can they stop you (brief Terry detention) or arrest/handcuff you (full custodial detention). What the Law Actually Says • Terry v. Ohio (1968) + Hiibel v. Sixth Judicial District (2004)
Officer sees facts → develops reasonable suspicion → then may briefly detain and ask questions or demand ID (in stop-and-ID states). • Dunaway v. New York (1979) + Florida v. Royer (1983)
You cannot be detained first “to see what we find.” Detaining you before having suspicion or probable cause is an illegal seizure under the Fourth Amendment. Illegal Sequence (Happens Too Often) Officer: “You’re detained, put your hands behind your back” → then starts asking questions or searching for justification. That order is unconstitutional. Any evidence or statements from it get suppressed, and it becomes a § 1983 false-arrest lawsuit. One-Line Rule You Can Say on Scene “Officer, am I free to go? If not, what specific crime do you have reasonable suspicion I committed right now?” If they cannot name it, the detention is illegal from the start. Investigation → suspicion → detention. Never detention → investigation. The second one violates the Fourth Amendment every time.
