As a contractor, I can see exactly what he did. He’s trying to shift the retention pond to be exclusively on your land. He cut down your trees so he could dig down. That’s why the grade looks lower. The grade also needs to be fixed

He ruined your property value in one fell swoop. I’d sue for everything he’s got.

The company who did the work is also on the hook for this! They didn’t perform any due diligence to confirm who owned the land they were destroying?! This is all just unbelievable! I am so sorry and so angry for you! 😡😡

As an HOA attorney, I’m in *shock* that anyone would approve permits or applications to fill or move a retention pond. Following for updates!

Civil engineer here 👋🏼 he can’t just “fill in a retention pond.” It’s designed to hold water for when it rains to prevent flooding. Civil engineering plans are public records that you can also get access to from the city that will show the pond & storm design calculations

If you haven’t already, See if google earth or Apple Maps still has aerial views of the property with the trees and screenshot those.

He was intending to use your land as his backyard. Because you have that fence it looks like only that part is your land when it’s not the case

Lawyer still, 100%. The HOA might be helpful now but they’re nothing really compared to the law.

Weird how the company he hired just “did what he asked”….. didn’t ask for a survey or anything?

I think in your other video you mentioned you were also getting a surveyor? As soon as that’s marked out, put up temporary fencing as I wouldn’t put it past this guy to sneakily continue to move the retention pond to your property. Also makes a clear boundary for any contractors

The retention pond is vital to prevent flooding. Make sure to contact the city regarding that. He potentially might get a big fine from them.

I’m a licensed insurance agent. A reputable tree Company would have had written consent from you to take out any trees. Make sure you sue his homeowner policy for liability, and check and see if he has an umbrella policy as well.

Of course, the permit from the city did not include anything on your property. You can’t get a permit to do something on someone else’s property.

You’re in Fulton County too… we have excellent tree protection. I bet he violated canopy restrictions too. I would start a civil suit as well as report him to every agency to make sure he pays fines. It can be up to $10k for EACH heritage tree. (At least that’s what it is in Sandy Springs) That’s likely why they pulled stumps away so quickly.
