@fre3dom.00: Under California Civil Code §§ 1485–1504, a debtor can make a lawful tender of performance—and if the creditor refuses it, the obligation is legally extinguished. The courts don’t care about a creditor’s attitude; they care about proper tender. When things escalate, Code of Civil Procedure §§ 995.710–995.770 let you make a deposit with the court in place of a bond or disputed performance. Once the deposit is made, enforcement must stop. The obligation shifts into the court’s hands, not the creditor’s demands. Legal tender. Offer of performance. Deposit in lieu of bond. California built an entire escape hatch into the law—most people never learn how to pull it. #CaliforniaLaw #LegalTender #OfferOfPerformance #CivilCode1485 #CivilCode1504
