while an order from the president is gone through several levels, ppl don't get imo how it really works and what the duty to refuse an unlawful order is meant to guard against. the president isn't some general sending troops here or there, his advisors bring in a problem and give him options for a solution and he selects one. most of the advice will be lawful. where it can get murky is on the field. I'll use an example nearly everyone has seen, lone survivor. recon mission discovered by potential adversarial combatants. two options, remove the threat and complete the mission (including 2 children) or abort the mission and take the risk of full discovery. the former, had say the Lt in charge issued the order to terminate the ones who discovered them, would be unlawful.

also a soldier refusing a order will get court martialed and then must defend his refusal of the order and prove the order was unlawful, illegal, and or immoral.

There needs to be a law that says if a lower court rules an order is unconstitutional and at least seven judges rule otherwise, the lower court judge is immediately disbarred and removed from the bench, unless there is a major change to the law or a significant amount of time has passed 10+ years.

This is what I am saying….. what’s interesting is people who are for what these lawmaker said never get the question: “Are/were you in the military?” but I get that question in excess. I have never served, but was raised a Navy brat and have a military spouse that has served…..I was a hard core liberal for years and have had millions of conversations about what I thought was wrong…..civilians have no idea the amount of legal and intel reviews are done before ANYTHING actually happens. 🤦♀️

100% fact come from military family and me and my cousin were just discussing this the other day the chain of command that those orders come down through if it was deemed unlawful there would be a challenge by the time it got to the courts the courts would determine whether or not it was an unlawful order not some stupid soldier no offense to soldiers not all of them are stupid they don't get to make that decision because the line that that order comes down through is so long if it was unlawful it would already have been stopped in the chain of command
