@chandlerroth55: I mean this with love but severance agreements are the employers way of buying your silence. The money is nice I’m not saying don’t take it but understand it comes with a huggeeee benefit to the company. It’s not selfless or generous all the time. They’re buying your silence and your promise to never ever ever not even once ever sue them. #lawyer
I tried to negotiate a severence agreement and ultimately they didnt give me what i wanted and i didnt sign. I thought they would fight harder!

I got paid for 7 months to leave. I gladly signed that agreement. It was 100% hush/don’t sue us money.

If they want to settle claims they need to act like they’re settling claims :)

This might be an obvious question but if an employee quits doc you need a severance agreement? Also is it mandatory if you fire someone? How do you calculate the deal?

When I was laid off during mat leave I consulted an attorney.. but the amount of money I could have potentially made in arbitration compared to my severance package I was already being offered.. it just didn’t make sense. I think it’s important to note some unethical attorneys may convince you to take legal action for their own benefit (of course this is the minority.. but it happens. It’s important to weigh the pros and cons before taking legal action

So what if the employer takes back the severance if they find out that they being sued? Wouldn’t that just be better to sign the agreement and get over with it?

It is always better to have an attorney write response language for you. I have successfully sued two major companies. Employers have insurance policies that often time will cover their legal fees so it's a easier lift to give you more than lawyer up in the state in which you reside.

Keep in mind that if you signed an NDA when you were hired, not signing a severance to avoid an NDA is pointless.
