I will say if they refuse the field sobriety test and the officers arrest them once they make it to the jail or the hospital a toxicology should be done if they come back where they are completely sober and not impaired the arresting officer personally & the department both should be liable for legal damages. Officers need to be ABSOLUTELY POSITIVE they are impaired before they arrest them!!!
