I covered a trial in Spokane, Washington, where jurors found a man not guilty of vehicle manslaughter, but during polling, several jurors said the verdict was not theirs. Turns out they mistakenly thought that if they couldn't agree on guilty or not guilty, the verdict was automatically not guilty, so the judge declared a mistrial. That remains the only time I've seen jury polling conflict with the stated verdict, and that didn't change tonight when Judge Richard Mrazik in Utah's Third Judicial District polled the eight jurors who convicted Kouri Richins of five crimes. (Yes, it only takes a jury of eight people to convict. In most jurisdictions, it's 12.) The judge identified each juror by badge number and asked, "Is this the verdict you voted in favor of?" All said yes. The camera focused on Eric Richins' sister, Katie Richins-Benson, and brother in law, who hired the private investigator who spearheaded the murder case against Richins. Richins, who's been in jail since 2023, was convicted of aggravated murder, attempted aggravated murder, forgery and two counts of insruance fraud for her husband’s March 2022 fentanyl overdose. She's to be sentenced on May 13. After polling them, Mrazik told jurors, "This trial is now finished. Thank you for your service. The American system of justice relies on your time and your sound judgment, and you have been generous with both." "You serve justice by your fair and impartial decision. All of my previous admonitions are now lifted. You may speak about this case with anyone or with no one at all. It is entirely up to you. You might be contacted in the future by the press or by the lawyers. You do not have to talk with them or with anyone else, but you may, if you would like. The choice is yours entirely," Mrazik said. "I'm now turning to the attorneys and instructing them to honor your wishes as officers of the court, if you indicate that you do not want to talk about this case, if you do talk about the case, please respect the privacy of your fellow jurors the confidences they may have shared with you during deliberation are not yours to share with others. Thank you, all of you for your service, please rise for the jury." Evidence showed Richins was deeply in debt and infatuated with portraying a luxurious lifestyle when she forged her husband's signature on an insurance policy and persuaded her housekeeper to obtain fentanyl pills for her. She was convicted of attempted aggravated murder for trying to poison her husband's bagel sandwich with fentanyl on Valentine's Day about three weeks before his March 4, 2022, death.
