The DUI investigation starts when he smells the alcohol/thinks DUI is a possibility. He hadn't even gotten to the part where he asks if she consents before she started challenging him. Cops usually ask you to get out of the car BEFORE the ask for consent to do the sobriety tests because if you deny them its easier for them to arrest you because youre already outside the car. These people are the worst 🙄
