One of the most successful plaintiff lawyers in the United States told a wrongful death trial jury on Friday that they’ll see many photos of the victims before they died “not because we’re trying to get sympathy.” “It’s because we, as I told you in the beginning, have the burden of proving what we’ve lost. And the only way that you can determine what someone has lost is to see the evidence of what they had,” Brian Panish said. “So what you're going to see is what this family had and what was taken from them, and worst of all, what they've been left with.
“So what you're going to see is what this family had and what was taken from them, and worst of all, what they've been left with." Panish represents Nancy and Karim Iskander, whose sons Mark and Jacob were killed when a woman speeding in her SUV struck them in a marked crosswalk on Sept. 29, 2020, near Westlake Lake in Los Angeles County. The driver, Rebecca Grossman, is serving 15 years to life in prison after a jury convicted her in 2024 of two counts of second-degree murder, two counts of vehicular manslaughter with gross negligence and one count of hit and run driving resulting in death or serious injury. An appellate court affirmed her convictions on March 17 in a 143-page opinion. The Iskanders are suing Grossman, her husband, Peter Grossman; and her ex-boyfriend, former Major League Baseball player Scott Erickson. Erickson was speeding in another SUV alongside Grossman when she hit the boys; witnesses said the drivers were racing. Trial began Friday (April 24). Panish spoke about each boy as their school photos were displayed on a courtroom monitor. “These are the kind of kids that you want to have in your community. They were respectful, kind, loving, smart and funny,” Panish said. Mark “was the big brother. He was gifted in math and science. He dreamed of being a neurosurgeon or a comedian.” Jacob “was a disciplined kid that at this age would wake up five or six in the morning and go for a run before he goes to school.” The boys went to a Lutheran school, and Jacob “loved learning and memorizing the Word of God.” Jurors saw video of the boys doing push ups together while slapping hands. “This kind of sums up the relationship. Just take a look,” Panish said. The video played for about 35 seconds. When it stopped, Panish said, “Their mom was filming that with great pride and joy. That will never happen again." This video has been edited for brevity. You can watch Panish’s entire 90-minute opening statement on my YouTube channel and Facebook page, where you can find videos of the other opening statements and the first witness’ testimony. #law #court #attorney #crime
