This doctor is trying to cite HIPAA, which does indeed bestow privacy rights in environments where patients could potentially disclose info subject to HIPAA protection So, the doctor has a valid point. This is NOT just another public location, assuming this federal statute itself does not violate the 1st amendment. Furthermore, a patient could conceivably sue that medical practice and the videographer in the event any patient info got picked up second-hand, published/disclosed which would otherwise be subject to patient comfidentiality per HIPAA. Videographer needs the education this time.
