Well it's true It's a public area. You can ask nicely and if the person says no then maybe move on until the person leaves. Both could be understanding .

Obviously the photographer had the right to ask for him to move, a decent person would but doesn’t need to leave. Plus tourism is ruining a ton of great places, locals are sick of it

They have the right to ask, as long as it isn't a demand. He has right to refuse a request as it is a public space. He could be kind and give the 2 minutes to get their shot and go back to resting.
