Nobody in the right here. This is not legal use of deterrent BTW. You can't claim self defense when you walk after them to use your weapon. Officers will generally ignore the wrongful use however the assailant in the case could potentially have charged brought up as well. It wouldn't help him and his assault charge but he could.
