The cop was in pursuit. Jurisdiction no longer matters.

not legal, hot pursuit laws only applies if the public is in danger or if a felony level crime was committed. the guy never ran from the police he was followed home by an officer and the officer turned his lights on as soon as the guy pulled into his garage. the officer had no warrant and was not welcome into the home, this is harassment and trespassing.

I was pretty interested in this. From what I saw, the legality of entering the home and arresting the driver is pretty dependent. A lot is context dependent which I don’t have access to. Generally police need a warrant to enter a homeowners garage. However, depending on the state, and some case law, hot pursuit may apply, where cops may follow suspects onto private property. These hot pursuit laws are typically only put into place for public safety and felony level offenses where not violating a homeowners rights is outweighed by the danger of not apprehending a dangerous suspect. It would be unlikely that a jury would find misdemeanor or infraction offense as justifiable reason to enter the homeowners private property without a warrant. PROBABLY not legal arrests if any were made.
