The important distinction between assault and battery is that assaulting someone does not necessarily mean placing your hands on someone. Assault is any act of intimidation perpetrated on a person. So getting in someone’s face, or aggressively approaching them, slamming things near them, could all be assault. Battery is the act of physically harming someone with your hands or a weapon. So assault with a deadly weapon means brandishing a deadly weapon in a manner meant to intimidate. Using that weapon would be considered battery with a deadly weapon.
