Why being shocked ? Controller is providing a service. The commander is ultimately the only responsible for the safety of his aircraft and he doesn’t have to comply with an ATC clearance if he deems it unsafe or against his company policies.

The pilot was right. Without access to the MRVA/MVA chart, the crew cannot verify terrain clearance below the published MSA. Company procedures require refusing such descents. ATC issues clearances, not orders, and any clearance may be declined for safety reasons.

The crew did excellent. The controller is there to assist and not to order anyone. The crew elected to stay higher and the controller MUST accept and assist.

As an airline capt, i’d say that it’s an excellent move by the Pilot, while still being polite. Flights are bound not only by airport charts and ATC, but also by manufacturer (aircraft type) limitations, state regulation, national law, company policy, and operator (airline) restrictions, on top of that, Commander’s safety discretion.. If an instruction plays against any of the one of those, it is his right to be safe and request for a more conservative clearance.

I dont think that frequency is a good place to discuss. Ubable means unable. Controller should not discuss about it, they may discuss it later on after landing

So, in mountainous regions, it is common to have your ground radar to be physically limited, therefore having higher vectoring altitudes than following a published procedure. Turkey is one example of such environment. To avoid ATC error (usually w ego issues like here), such airlines ask their captains/crew to cross check the vectors against a minimum vectoring chart (radar capability limited). If such vector is lower than the chart value in this sector (radar limited), such vector shall be declined. Has nothing to do with msa. Yes, msa is the obstacle limit, but you are not safe to go to an altitude that is lower than radar capability while not following a published procedure. Does it make sense? You are literally invisible to the atc and not on a published procedure. Hello, who wants this gambling?
