At 71, Douglas Carter walked out of a Utah jail after 41 years in state custody, most of it on death row. The reason was a lab result that took decades to arrive. Carter was convicted of killing Eva Olesen in 1985. She was the aunt of Provo’s police chief at the time. He was sentenced to death that year, and again after a 1992 retrial. Over the years, Utah courts rejected numerous appeals. Carter has always maintained his innocence and says the signed confession in his case was coerced. His lawyer says no DNA testing was done on the evidence before June of 2026. Then, in September, newly analyzed DNA from the scene came back. Blood on a doorknob and genetic material on the handle of the knife did not match him. Utah County prosecutors withdrew their plan to seek the death penalty. On Sept. 28, Judge Derek Pullan ordered Carter released on bail, over the objections of Olesen’s family. He must wear a GPS monitor while he waits for a new trial. The picture is not simple. The judge said the new DNA further weakened the case against Carter, but that a reasonable jury could still conclude he committed the murder. Prosecutors have stressed that the results do not, on their own, prove his innocence. Olesen’s family said they will not comment on the guilt or innocence of any individual. His defense attorney, Neal Hamilton, said Carter is leaving jail with 41 years of “state-induced trauma.” For the first time in four decades, Carter is preparing for what comes next outside a cell, and the case that began in 1985 is still waiting for its final answer.
