There is a court case from 2008. Kirby V Duva. It sets the precedent that an officer CANNOT use self-defense as a justification for lethal force when he/she unreasonably places himself/herself in harm's way; nor is it legal to shoot at a fleeing vehicle for the sole purpose of stopping it b/c the danger it poses to others on the road. There ABSOLUTELY no reason for this tragedy and it should never have happened.
