you cannot be in the driver seat of a motor vehicle while intoxicated. even you you say you are not gonna drive. you have the opportunity to drive and as far as the eyes of the law goes you have intent to drive. i was once arrested for dui for opening the passenger door to get a pack of cigarettes. all because i had the keys in my hand.

If you are ever in this situation, after the cop made her get out, you tell the cops that you’re not doing any field sobriety test, and our conversation is over they can speak with my attorney, take me to jail and give me a pillow. Your attorney will be able to fight this.

is she's in a private parking lot. Do cops still have the authority to do anything I know if you get an accident in a mall parking lot. The cops don't do nothing cause it's private property.

She was not driving also , I have never seen one person pass the field sobriety test, not one . Even people that never had a drink but the police think they we’re drunk don’t pass that.. I don’t even think I can pass that sober.

If she’s behind the wheel or even in the passenger seat—WITH KEYS—she can be arrest with DUI/DWI etc. Bc there is a CLEAR APC of the vehicle—Actual Physical Control. Meaning they had the capacity to be able to drive, and ONLY with that it makes it a clear and clean arrest.
