So enlighten me- How does it work with a puddle that would repeatedly need be treated night after night. If it’s out of the storm window of time essentially. Now we’re talking a refreeze of a puddle that could go on for weeks. It would be avoidable if there wasn’t a massive pothole there. Does it then fall more so under landlord? Especially if they did not make the contractor aware of said ice (Stated within our contracts). Essentially bottom line, rest of the lot is dry. This is completely avoidable if the hole is repaired, so landlord I’d think? Their negligence to repair that opened the risk to never ending ice. Let me know

Why are we contractors always held liable for people that can’t walk correctly on a sunny day. Why can’t we sue the street department for accidents if they haven’t plowed or applied any salt?? Contractors need more protection against unfair lawsuits.

You sue for northern weather conditions. Why don’t you sue for falling on dry pavement? Can’t sue anything but their own ego. But when it comes to snow removal you guys love the free rep. When the client fell on such ice. Was it an emergency that she left her home with the below freezing temps? Or was she headed to TJmaxx out of Bordem and her selfishness causes me another notice of claim. Because she thinks she’s sueing a big box storm and not a small business owner.

I had a water pump for the pond at a local park flooded the parking lot over 3 feet deep flooding my truck. They called people out but didn’t block the area off for 2 days later. Tried to get the city to fix my truck and they denied me and no attorney wants to take the city on

More of a parking lot problem than an ice problem it looks like, but still a problem nonetheless. You really can’t salt that big of a puddle effectively and I doubt anyone is walking directly through that, but every time a car drives through it looks like water gets splashed out and that water freezes. That’s a hazard. So unless the owner is paying someone to salt continuously ( and even then) it would be though. The asphalt needs to be fixed so there isn’t a huge hole there that holds water and becomes a risk.
