I hope the state can and do charge him. but MN did say they don't/haven't investigated without BCA which has been locked out. so they can but they don't have the investigative tools readily available. also the supremacy clause is an uphill battle but seems entirely winnable if done well

I’ve seen a lot of comments to this effect and it’s by design. The administration wants you to believe that the FBI has more power over this investigation than it really does. The regime wants you to feel like it will be impossible to hold ICE accountable for their crimes but that is not true.
