What's going to be real interesting in Lopez, is how much Hawaii's arguement is about Hawaii's history of arms regulation, and the spirit of Hawaii. Their position is pretty much that since they weren't a part of the country near the founding, that they should be able to use Hawaii tradition instead of US tradition. I don't think the Justices will go for it, but I thought that was an interesting angle.

Justice Scalia had no problem ignoring linguistic analysis regarding the meaning of “bear arms” at the time the 2nd amendment was written when it didn’t fit his judicial activist views. He also completely ignored the first clause of the amendment, its historic understanding, and its ties to Congressal authority over militia.
