Smith v Hughes (explained simply). This case says that if you make a mistake about what you're buying, that's usually your problem – not the seller's. Here's what happened. A farmer named Smith showed a racehorse trainer named Hughes a sample of his oats. Hughes agreed to buy a large amount at a set price. Hughes had assumed they were old oats – the only kind his racehorses could eat. They were new oats. Smith had never said the oats were old. Age wasn't mentioned at all. Hughes refused to pay. He argued that he'd made a mistake, and that Smith must have known he thought they were old oats. The court disagreed. Smith knowing about the mistake wasn't enough. He hadn't caused it.
