It's not difficult to see why the police pay out approximately £16 million every year in compensation to members of the public for officer misconduct.

Even if he has sworn .. the officer can not make a complaint he has nothing to report. There is not a member of the public to report this person.. it’s ok for his Sargent yet there’s a problem when a member of the public utters the same language when reporting what was said.. thinking he’s smart.. if ask what was the word that was spoken what should he do find a pen an paper an write it down.. why has this officer take his complaint . So why is he in the job .. he pick an choose when he takes a report from a member of the public. Because it another officer he can’t take the complaint .. is any officer exempt of the law ?

The trouble with the polices is that they use this stupid law section 5 public order offence but they are the worst abuses of this. I’ve worked around the Police and they use foul language consistently to talk about people have arrested just among themselves they insult each other they use words of frightened and a piece of behaviour to talk about people in general and then you say one word and they use that stupid law. It’s pathetic.

Harvey v Director of Public Prosecutions [2011] EWHC Crim B1 Justice Bean’s judgment in Harvey v Director of Public Prosecutions in which he overturned Mr Harvey’s conviction under section 5 of the Public Order Act 1986 for swearing at a police officer. November 2011, High Court, Justice Bean ruled that swearing at police officers does not automatically constitute a crime under the Public Order Act, as it is unlikely to cause them "harassment, alarm or distress." This decision was based on the argument that police officers are frequently exposed to such language and should not be easily offended by it.
