I trusted my elder lawyer 5 years ago she said I didn’t need an irrevocable trust. She could save my house. Now almost 5 years later hubby has dementia. She wants 6k to file for Medicaid. I know why she was untruthful now it’s to late. Be careful who you trust

You also need a diagnosis for Medicaid to pay for the nursing home care. I just went through this with my dad, there’s so much misinformation out there about Medicaid coverage.

I ended up putting my mom's home and assets in a Legacy trust through an Elder Law Attorneys office. I did not realize the extent you have to go through to protect what my parents worked so hard for.

We went to an estate lawyer thinking the same thing but she changed our views. First if you have an irrevocable trust, then you have to pay rent to yourself on the home, and second if my parents end up needing some kind of extra care, then the million $ they saved can keep them comfortable in that home, with better care than some state facility. It really put it into perspective for me.
