@meghannmcuniff: Judge Tony Graf didn't allow a prosecutor to testify behind closed doors yesterday in the case against Charlie Kirk's alleged killer, but he allowed the prosecutors' daughter to testify off camera. Graf heard the testimony as part of an evidentiary hearing into whether the Utah County Attorney's Office should be removed from the capital murder case against Tyler Robinson because the daughter of the office's deputy chief was at the event at which Kirk was shot and killed. Prosecutors and the defense wanted Chad Grunander and his daughter to testify in a closed hearing, but Judge Graf said the hearings would remain open except no video or audio recordings of the daughter. Regarding Grunander, "The court further finds that the interests of openness and transparency outweigh the asserted grounds for closure as to that testimony and the rights of the parties and witnesses can be adequately protected through least restrictive means available to the court. For those reasons, the request of both the state and the defense to conduct the prosecutor's testimony in a closed section session is respectfully denied." Regarding Grunander's daughter, "The court finds that closure of the adult child witness' testimony is not necessary and would not be narrowly tailored under the circumstances presented. The court further finds that the interests of openness and transparency outweigh the asserted grounds for closure as to that testimony, and that the rights of the parties and witnesses can be adequately protected through least restrictive means available to the court. For those reasons, the request of both the State and Defense to conduct the adult child witness' testimony in closed session is partially denied." "Accordingly, the courtroom will be temporarily closed and all parties, a member of the media will be excluded for the limited purpose of calling the adult child witness to the stand to state identifying information. Once that limited portion of the proceeding is complete, the courtroom will be reopened and members of the public and the media will be permitted to re enter during the testimony the adult child witness, no audio or video transmission will be allowed and no photographs of the witness will be taken. At the conclusion of the adult child's witness' testimony, audio and video transmission of the hearing will resume and will continue through the remainder of the proceedings." #law #crime #legal #court #judge
