@sacramentourbanmedia916: A federal judge on Thursday directed the Trump administration to help arrange the return of certain Venezuelan migrants he previously determined were unlawfully deported under the Alien Enemies Act and later released from a Salvadoran prison to other ქვეყნies. U.S. District Judge James Boasberg said only a limited number of the affected Venezuelans are expected to seek a return to the United States to continue contesting their detention and removal. He noted that any who come back would be placed in immigration custody upon arrival. Attorneys for the men have until Feb. 27 to notify the court how many plaintiffs want to travel independently to a U.S. port of entry or prefer to be transported from a third country to participate in court proceedings. The ruling follows Boasberg’s December decision finding that the administration violated the due process rights of a group of 137 Venezuelans deported to El Salvador last March. The removals were carried out under the Alien Enemies Act, a wartime statute President Trump invoked to expel Venezuelan nationals accused of ties to the gang Tren de Aragua. Earlier in the litigation, Boasberg concluded that officials proceeded with some deportation flights despite a court order requiring the Department of Homeland Security to turn planes around before they reached a Salvadoran prison. Citing what he described as serious constitutional violations, Boasberg wrote that the court would not allow the plaintiffs to remain without a remedy. While emphasizing the need for caution in matters touching on foreign affairs, he ordered the government to take specific steps to facilitate the return of those migrants who wish to resume their legal challenges in U.S. courts. Others, he said, may continue pursuing claims from abroad. The judge referenced a prior Supreme Court decision that required the administration to facilitate the release of Kilmar Abrego Garcia from Salvadoran custody after officials acknowledged he had been mistakenly deported. Boasberg also criticized the government’s response to his request for proposed solutions, writing that officials had effectively dismissed the court’s concerns. He concluded by ordering the administration to assist in bringing back any plaintiffs who choose to return from third countries to pursue their cases.#fyp #viral
