If you receive samples and use them for personal use then yes you have to pay tax on them, if you receive the sample and use it exclusively for business use meaning you keep the product ONLY for promoting than you declare the sample as income and then declare it as an expense which brings it to 0. My only question is TikTok doesn’t let you see more than 3 months worth of samples that you’ve received, so there’s no way to check the date and value of the sample at the time you received them, so if we can’t check how will Hmrc know🤔🤣

I’ve seen a couple of big creators who have been doing this for years say if you are gifted as a content creator then yes but if TikTok shop samples are just being used for content then no as they are seen as business tools, it’s so confusing

What about if you buy from your own showcase to promote but not personally use? Also some are saying to register as a limited company rather than sole trader, what’s your thoughts on this Emma? Xx

Iv spoke to tons like you and a few have told me a % of the sample value can go through as an expense as you can’t work without samples so if I get something purely for content or poor quantity it’s 100% if a dress Iv done 30 videos on and wear it’s 50%, kitchen roll I do as 10% ect so you pay tax on the elements that is personal use. HMRC have said they will make more clear guidelines this year but this is how I’m doing it. It’s still such a grey area but ultimately samples are needed for work purposes but I am happy to pay tax on the personal use side. I also explain why I allocate that % Incase it’s ever followed up

you dont there an business tool we couldn't do videos without them. however if you get rid of your "samples/stock" or keep for personal use then its classed as a gift in kind so therefore pay tax on it. the vouchers theres a reason we pay like 1p as there actually an expense. Iv spoke to a few accountants and they say the same.

What if it’s your second income and you’re already paying tax or PAYE and NI from your 1st job which my employer pays. If the HMRC allows you to earn the 12570 before taxing I’m confused because my tax code allows me to earn a certain amount in my job so is the self employed amount extra or different thanks ☺️
