I’d give Mike another chance. I’d push back and advocate for this young man that’s being overworked. I’m hoping he’s being paid appropriately because there are so many companies underpaying their employees AND expecting the moon.

Mistakes happen when people are sleep deprived. Would you rather he take a shirt nape to recharge or make a huge mistake that could be the difference between winning or losing at trial???

We can go longer without food than sleep. The conditions you describe seem way out whack. If he's previously been performing well, at the very least a reprimand or probation . The employer seems to be mistreating staff.

Push back, suggest a written reprimand and a job discussion, reiterating to him that he's gotta do whatever it takes and ultimately, communicate better. But if Mike has to go, it's still his fault, as mean as that sounds.

I would push back… multiple 10-12-14 hours a day … you get tired. Mike might need to learn to power nap. 20-30 min. Everyone needs a brain break

I will give my a written notice regarding him sleeping on the job. then I would check the Arrangements on the hours so the employees get better rest.

Being overworked and overtired leads to stupid little mistakes. scheduling 30 min 'sleep' breaks would help elievate that. Should he have told someine he was going to take a 30, yes. Did he probable oversleep, also yes. But tje man is dedicated enough to sleep in the office. Push back and have the talk about better communication.

A good first question to ask is if they've had this type of situation before and what they did. You also want to know if something like this has happened with him in the past and what his current work performance is like. Then I would talk to the manager and ask about how they are handling people's mental and physical stress during these trials, because when people are under that type of stress, after a while it becomes a safety issue. They can go to the break room to get a cup of coffee and spill hot coffee all over themselves or they could do a quick run to get food for the team and fall asleep at the wheel. I think a conversation should be had with him that if he needs a break he should let someone know and they can arrange that but I wouldn't discipline him. Because one could make the argument that the company culture and expectations are the reason why he's falling asleep on the job like that.

I am feeling really badly for Mike!!! That is a stupid long day!!! No human can consistently work like that without some sort of break. The trial may be urgent, but nobody can perform 100% under those conditions.

A coworker got reprimanded for sleeping on a couch in the break room during lunch. It was ridiculous. Meanwhile my husband’s office has sleep pods so people can take naps if they need them. A 20 min nap can help the brain function way better….especially if it’s been on overload for days on end.
