Your land is private land. You have every right to fence off your land and put a gate up on a private easement. This is fully allowed. Protecting the food source for your animals is also allowed.

This just feels so simple after seeing the episode. Where’s the property line, is the road/gate within your property? If so then no one has any legal standing to tell anyone what to do with that gate. Frustrating to see, can’t imagine having to live with it.

Genuine question: is the easement YOUR private road that your family solely pays to maintain and have access to? Or is it maintained by all those that own property on said easement? I lived in a rural town of less than 300 people (35min outside of Portland, OR) on a private easement for many years. It was and still is the responsibility of ALL owners on that private road to maintain it which grants them the use of it without restriction. Therefore they all have access to it. Is that not also the case in MT?

The show was frustrating, partly because it wasn't explained very well. They should have shown an aerial map of both of your property lines and where the gate is. Also, because there was no resolution. I hope it all works out for you

I don’t think I would like someone else’s horses destroy my dense either. If he doesn’t want his horses on this guy’s property he needs to put up his own dense up. I think this guys neighbor wants their horses to roam free and in this fast and age it doesn’t work that way
