he was disoriented. He did not have the mental capacity to refuse. The whole system failed this man. The EMS crew was part of the problem and needs investigated also

As a LEO and former EMT, I have no clue how he ended up in jail. This guy is alert and oriented x 0 and cannot refuse to go to the hospital. Those EMT’s are required by law to take him to the hospital. EMS is in charge on medical calls and have final say over law enforcement.

Nah this falls on EMS firstly, they recognized he was disoriented and should have used implied consent to bring him to the hospital. Ems should have taken control of the scene. The officer is at fault also ems said it’s medical and didn’t transport.

This is a easy call. Use deem him incapacitated, and use implied consent and have an ambulance. Take him to a hospital.
